Arbitration will be conducted on an individual basis. To the fullest extent permitted by applicable law, disputes may not be consolidated with claims of other individuals or resolved through class, collective, or representative proceedings.
Nothing in this section prevents either party from seeking appropriate relief in small claims court where the claim qualifies, or from seeking injunctive or other relief relating to intellectual property rights, fraud, theft, unauthorized access, or other claims that may lawfully be excluded from arbitration.
If a dispute is not subject to arbitration and proceeds in court, the parties consent to jurisdiction and venue in the appropriate state or federal courts located in Wyoming, except where applicable law requires otherwise.
If any portion of this arbitration provision is determined to be unlawful or unenforceable, that portion will be severed or limited to the minimum extent necessary, and the remaining provisions will remain effective to the extent permitted by law.
